1. About Our Services

The Heena Factor provides business clarity consulting, assessments, frameworks, coaching, facilitation, and advisory services designed to help organizations improve alignment, communication, decision-making, and execution. All implementation decisions remain the responsibility of the client.

2. The Nature of the Clarity Transformation

The Clarity Transformation Program is an assessment and advisory engagement. It may identify opportunities for improvement, validate existing practices, or conclude that an organization demonstrates strong performance across major clarity dimensions. The absence of significant findings does not constitute a failure of the engagement. Confirmation of organizational strengths is considered a valid and valuable outcome.

3. Recommendations Are Advisory

All findings, reports, frameworks, roadmaps, recommendations, and action plans are advisory in nature. Clients retain responsibility for business decisions, implementation, resource allocation, and change management.

4. No Guarantee of Results

We do not guarantee revenue growth, profit growth, cost reduction, productivity gains, operational improvements, business outcomes, or any specific return on investment (ROI). Results depend on execution, leadership decisions, organizational readiness, and external factors.

5. No Performance Warranty

Services are provided on a best-effort basis using professional judgment, experience, and established methodologies. No warranty is provided regarding future performance or achievement of objectives.

6. Client Responsibilities

Clients agree to provide information that is accurate and reasonably complete. Findings and recommendations may be affected by incomplete, inaccurate, or unavailable information.

7. Payment Terms

All fees are payable according to the terms presented at the time of purchase or engagement. Access to services may be delayed, suspended, or terminated if payment obligations are not fulfilled.

8. Refund Policy

All sales are final. Due to the nature of consulting, advisory, assessment, and professional services, no refunds, partial refunds, or credits will be provided once an engagement has been purchased or commenced.

9. Confidentiality

Information shared during assessments, consultations, or engagements will be treated as confidential except where disclosure is required by law or necessary to protect legal rights and obligations.

10. Privacy & Data Usage

Information voluntarily submitted through forms, questionnaires, assessments, downloads, consultations, or other interactions may be used to respond to inquiries, schedule meetings, deliver services, provide requested resources, improve service delivery, and send relevant service-related communications. We do not sell personal information to third parties. You may unsubscribe from non-essential communications at any time.

11. SOPDA Framework & Download Terms

The SOPDA Framework and all associated materials are the intellectual property of The Heena Factor. Users may download materials for personal use, share them internally within their organization, and apply the framework within their own business. Materials may not be resold, republished as original work, commercially redistributed, or used to create derivative commercial products without written permission. SOPDA resources are educational and do not constitute legal, financial, tax, employment, regulatory, or professional advice.

12. Intellectual Property

All frameworks, methodologies, reports, templates, assessments, presentations, content, and intellectual property provided by The Heena Factor remain the property of The Heena Factor unless otherwise agreed in writing.

13. Limitation of Liability

To the fullest extent permitted by law, The Heena Factor shall not be liable for direct, indirect, incidental, consequential, special, or business losses arising from the use of services, recommendations, or implementation outcomes. Any liability shall be limited to the amount paid by the client for the specific service giving rise to the claim.

14. Right To Decline Engagements

The Heena Factor reserves the right to decline, suspend, or terminate an engagement where continuation is inappropriate, impractical, unlawful, or inconsistent with professional standards.

15. Changes To These Terms

These Terms & Conditions may be updated periodically. The most current version published on the website shall govern future engagements.
